[Teachldsseminary] Fair use copyright

This exception is often misunderstood and is complicated -- as
evidenced by the large body of case law, and the number of conflicting court
decisions. [BTW - I teach a college course on this.]
It would be wrong to assume that the Fair Use exception allows
educators to do anything they want with copyrighted material. A common court
decision factor is how much of a work is used -- and in the case of a piece
of artwork (or photograph), if you are using the entire work, and **IF** the
creator of that work were to sue you, you would probably lose the case.
The fair use exception is not as cut and dried as might be
interpreted from the section of the law you cited below. This is especially
true if you're copying and pasting things from the Internet. This
intellectual domain is in major law flux right now.
My bottom line -- stay far away from the edge of the cliff (as to
whether it is legal or not) and just use church authorized artwork. If you
don't have written permission, don't use it!
Thanks, but now I've got to get ready for classes ... so no more
emails from me for a while!
Dave
